Your Privacy is Important to Us
At Enchanted Beauty Plastic Surgery, we are committed to protecting your personal and health information, even though we are not a covered entity under the Health Insurance Portability and Accountability Act (HIPAA). We do not accept insurance, Medicare, or Medicaid, and we do not transmit electronic health information to health plans. As a result, we are not subject to HIPAA, but we voluntarily follow strong privacy and confidentiality practices in accordance with Texas law and professional medical ethics.
Information We Collect
To provide care and manage your account, we may collect the following:
- Name, date of birth, and contact details
- Health history, symptoms, diagnoses, and treatment records
- Payment information (CareCredit, cash, or credit card data)
- Appointment history and care notes
How We Use Your Information
We use your information only for legitimate purposes, including:
- Providing direct medical care
- Maintaining accurate medical records
- Processing payments
- Communicating with you about your care
We will honor reasonable requests regarding how you wish to be contacted.
How We Protect Your Information
We follow reasonable administrative, technical, and physical safeguards to protect your information:
- Our staff receives privacy and security training
- Paper records are stored securely in locked areas
- Electronic records are protected by passwords and encryption
- Only authorized personnel have access to your information
Your Rights Under Texas Law
Even though HIPAA does not apply to this practice, you have rights under Texas Health & Safety Code Chapter 181, including:
- The right to review and obtain a copy of your electronic medical record (within 15 business days of a written request). We may charge a reasonable, cost based fee.
- The right to notice that your protected health information is subject to electronic disclosure. We will not electronically disclose your protected health information without your authorization unless it is being used for the purpose of treatment, payment, health care operations or as otherwise authorized or required by state or federal law.
- The right to know how your data is used and maintained
We will not sell your protected health information.
We will obtain your permission to use or disclose your protected health information for marketing communications. You have the right to request that your name be excluded from our mailing list.
Third-Party Financing
We accept CareCredit and Cherry as forms of payment. Please be aware that CareCredit and Cherry are separate companies with their own privacy policies. We do not share your medical information with CareCredit or Cherry, only the information required to process payment.
